This website, wetrackeverything.com (the “Site”), is operated by Chris Tarrolly, 826 N. Cass St., Milwaukee, WI 53202, United States. Throughout the rest of this document that person is referred to simply as “the Webmaster” (also “we”, “us” and “our”). “You” means anyone who visits or uses the Site.

1. Acceptance

By accessing or using the Site you agree to these Terms and Conditions. If you do not agree with them, please stop using the Site. These Terms apply alongside our Privacy Policy and Cookie Policy.

2. What this site is, and what it is not

The Site publishes independent articles, guides and reviews about ad tracking, conversion attribution and related software. The Webmaster is not the vendor, developer or reseller of any software described here, and has no control over it. Nothing on the Site is an offer to sell software, and no contract for any third-party product is formed with the Webmaster.

If you buy or subscribe to a product mentioned here, your contract is with that vendor alone. Their terms, prices, plan limits, billing, refunds, support and guarantees are theirs, may change at any time without notice to us, and must be confirmed on their own website before you commit.

3. Affiliate disclosure

The Site is monetised through affiliate links. If you click a link to a recommended product and go on to start a paid subscription, the Webmaster may receive a commission from the vendor. This costs you nothing extra: you pay the same price you would pay by going to the vendor directly.

This disclosure is made in line with the United States Federal Trade Commission’s Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 CFR Part 255), and with equivalent transparency obligations in the European Union, including the Unfair Commercial Practices Directive as amended.

A commercial relationship exists, and you should read what you find here with that in mind. It does not change the editorial position taken on the Site, and we do not publish claims we believe to be untrue in order to earn a commission. It does mean the Site is not a neutral or exhaustive comparison of every product on the market.

4. No professional advice and no guarantee of results

Everything on the Site is general information, published for educational purposes. It is not marketing, legal, financial, tax or accounting advice, and it is not tailored to your business. You should take your own professional advice before acting on anything you read here.

Any figures, percentages, examples or scenarios shown are illustrative. They are not a prediction or a promise of results. Advertising outcomes depend on your market, your offer, your budget, your creative and many other factors outside anyone’s control. You may get better results than the examples shown, worse results, or no results at all.

5. Accuracy of the content

We take reasonable care to be accurate at the time of writing, but software changes constantly. Features, limits, integrations and prices described here may be out of date by the time you read them. The Site is provided on an “as is” and “as available” basis, and we do not undertake to keep every page current.

6. Acceptable use

You agree not to use the Site to break the law, and in particular not to:

  • attempt to gain unauthorised access to the Site, its server or its database;
  • interfere with the Site’s operation, including by overloading it or introducing malicious code;
  • scrape or harvest content at a scale that burdens the service, or in breach of section 7;
  • submit content through a form or comment that is unlawful, defamatory, misleading, infringing or abusive;
  • use any automated system to submit forms or comments.

We may remove any submitted content and restrict access to the Site where we reasonably believe this section has been broken.

7. Intellectual property

The text, layout, graphics, illustrations and code of the Site belong to the Webmaster or are used with permission, and are protected by copyright and other intellectual property laws. You may read, print and share pages for your own personal or internal business use, and quote short extracts with clear attribution and a link back.

You may not republish substantial parts of the Site, or use its content to train machine learning models, without written permission. Trade marks, product names and logos of third parties appearing on the Site belong to their respective owners and are used for identification only; their appearance does not imply any endorsement of the Site by those owners.

8. Content you submit

If you send us a message or leave a comment, you confirm that the content is yours to send and does not infringe anyone’s rights. You keep ownership of it, and grant the Webmaster a non-exclusive, royalty-free licence to store it, and to publish it where it was submitted for publication. We may edit or remove comments, or decline to publish them, at our discretion.

9. External links

The Site links to websites operated by other people. Those links are provided for convenience. The Webmaster does not control those sites, does not endorse everything on them, and is not responsible for their content, their products or their handling of your data. Following an external link is at your own risk.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, the Webmaster will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, data, goodwill or business opportunity, arising out of your use of the Site or your reliance on anything published here, or arising out of any dealing you have with a third-party vendor found through the Site.

Where liability cannot lawfully be excluded, it is limited to one hundred United States dollars (USD 100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under the law that applies to you. If you are a consumer resident in the European Union or the United Kingdom, your mandatory statutory rights are not affected by these Terms.

12. Indemnity

You agree to indemnify the Webmaster against any claim, loss or reasonable cost arising from your breach of these Terms or your unlawful use of the Site. This does not apply to consumers to the extent that the law where you live does not permit it.

13. Availability and changes to the site

We may change, suspend or discontinue any part of the Site at any time, and may remove or amend content without notice. We are not obliged to keep any particular page available.

14. Changes to these terms

We may revise these Terms from time to time. The version in force is the one published on this page, and the date at the top shows when it last changed. Continuing to use the Site after a change means you accept the revised Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wisconsin and the federal laws of the United States, without regard to conflict-of-law rules, and the courts located in Milwaukee County, Wisconsin have jurisdiction over any dispute.

If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of the mandatory rules of the country where you live, nor of your right to bring proceedings in the courts of that country. EU consumers may also use the European Commission’s online dispute resolution platform.

16. Severability and entire agreement

If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, with the Privacy Policy and the Cookie Policy, form the entire agreement between you and the Webmaster regarding the Site.
